By using Heater, you agree to these terms. Please read them carefully.
1. Acceptance of terms
By downloading, installing, or using Heater (the "App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.
2. Eligibility
You must be at least 18 years old to use Heater. By using the App, you represent that you are of legal age in your jurisdiction. The App contains content related to gambling and is not intended for minors.
3. The App's purpose
Heater is a tool for tracking card distribution in blackjack. It is intended for educational purposes, home practice, and analytical study. Heater is not a gambling platform — no real money or virtual currency is wagered through the App.
Heater does not guarantee winnings. Card counting reduces, but does not eliminate, the house edge. Variance can produce significant losses even with perfect play. Never wager money you cannot afford to lose.
4. Your responsibility for legal use
Card counting is not illegal in most jurisdictions, but its acceptability varies. Many casinos prohibit card counting and may refuse service, ban players, or void winnings. Using a phone or any device at a live blackjack table is prohibited in many jurisdictions, including Nevada under NRS 465.075, and may be a criminal offense.
You are solely responsible for understanding and complying with the laws and rules that apply to where and how you play. Heater's developers are not liable for any consequences arising from your use of the App at a casino, online gambling site, or any other venue.
5. Account and security
When you create an account:
- You must provide accurate and current information
- You are responsible for maintaining the confidentiality of your password
- You are responsible for all activity that occurs under your account
- You must notify us promptly of any unauthorized access
We reserve the right to suspend or terminate accounts that violate these terms or are used in a manner that harms the service or other users.
6. Subscriptions and payments
Heater offers a free tier with usage limits and a paid Pro tier with unlimited usage.
Free tier
Anonymous users receive 10 cards counted per day. Signed-in free users receive 50 cards per day. Limits reset at midnight local time.
Pro subscription
Pro is offered at $9.99 USD per month or $79.99 USD per year, with a 3-day free trial for new subscribers. Prices are subject to change. Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period.
Payment processing
Subscriptions are processed by Apple App Store or Google Play according to their respective terms. We do not handle payment information directly. To cancel a subscription, manage it through your Apple ID or Google account settings.
Refunds
Refund requests are handled by Apple App Store or Google Play. We do not issue refunds directly.
7. Acceptable use
You agree not to:
- Use the App for any unlawful purpose
- Reverse engineer, decompile, or attempt to extract the App's source code
- Use the App to harm others, including by enabling cheating or fraud at gambling venues that prohibit such tools
- Share your account with others to bypass usage limits
- Create multiple accounts to abuse the free tier
- Distribute, sublicense, or resell access to the App
8. Intellectual property
Heater, its name, logo, and all software, design, and content within the App are owned by Heater and its operators. You receive a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only.
9. Disclaimer of warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or that calculations and recommendations are 100% accurate. While we strive for accuracy in card counting algorithms and basic strategy, we cannot guarantee mathematical perfection in all situations.
10. Limitation of liability
To the maximum extent permitted by law, Heater and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Gambling losses or financial losses arising from use of the App
- Casino bans, ejections, or legal consequences from using the App at a venue
- Loss of data or session history
- Service interruptions
Our total liability to you for any claim arising from these terms or your use of the App shall not exceed the amount you have paid to us in the 12 months preceding the claim.
11. Termination
You may stop using the App and delete your account at any time via the in-app Settings screen. We may suspend or terminate your access if you violate these terms. On termination, your account data will be deleted as described in our Privacy Policy.
12. Changes to these terms
We may update these terms from time to time. Material changes will be communicated via in-app notice or email. Your continued use of the App after changes constitutes acceptance.
13. Governing law
These terms are governed by the laws of Norway, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Norway.
